En pratique, l’État étranger dispose d’un accès aux fichiers des immatriculations lui permettant d’adresser le PV au propriétaire du véhicule – uniquement pour les excès de vitesse, le défaut de port de la ceinture de sécurité, le franchissement d’un feu rouge la conduite en état d’ébriété, la conduite après usage de stupéfiants, le défaut du port du casque, la circulation sur une voie interdite, et l’usage illicite d’un téléphone portable.
Un État tiers n’a aucun pouvoir de contrainte en France sur un ressortissant résident en France pour une infraction même commise sur son territoire.
Ainsi, toute lettre menaçante sur en-tête officiel d’une administration étrangère, d’une société de recouvrement française ou même d’un huissier de justice, s’assimile en règle générale qu’à une simple intimidation pour payer le PV.
En effet, seules les sanctions relevant d’une décision définitive et retranscrite par une décision judiciaire d’un tribunal français s’imposent à l’usager.
