Conduire pieds nus, torse nu ou encore en tenant une glace à la main, voilà autant de situations visibles sur les routes des plages.
Si ces comportements ne constituent pas en tant que tel des infractions au Code de la route, certaines verbalisations peuvent toutefois être juridiquement possibles.
En se fondant sur l’article R.412-6 du Code de la route, vous pourriez être sanctionné si vous ne vous trouviez pas en état et en position d’exécuter commodément et sans délai toutes les manœuvres qui vous incombent.
Si l’agent estime en effet que vos faits et gestes sont empêchés par votre comportement au volant (tenu en mains d’une glace, d’une carte, conduire pieds nus, …), la verbalisation sera tout à fait possible (jusqu’à 150 euros d’amende).
En cas d’accident, votre droit à indemnisation pourrait même être réduit si le juge estime que vous étiez mal chaussée pour conduire.
Conduite torse nu ne pose pas de problème pour un conducteur masculin, mais une conductrice dans la même situation risque d’être sanctionnée pour exhibition sexuelle.
Le retour de la plage est parfois synonyme de relâchement dans le port de la ceinture de sécurité. Retenez également que tout siège équipé d’une ceinture de sécurité doit être occupé par une seule personne. Rappelons qu’en cas d’infraction, le conducteur du véhicule non attaché s’expose à une perte de 3 points sur son permis de conduire et à une amende forfaitaire de 135 euros. Si le passager ne respecte pas lui-même cette réglementation, il sera alors redevable d’une amende de 135 euros sans perte de point pour lui comme pour le conducteur. Si le passager fautif est mineur, seul le conducteur est redevable du paiement de l’amende.
Enfin, pour ceux qui transportent un animal de compagnie, sachez qu’il doit solidement être arrimé au véhicule. Il ne doit jamais être placé à l’avant pour ne pas gêner le conducteur qui serait alors en situation d’être verbalisé.
